What is the California Consumer Privacy Act (CCPA)?
The California Consumer Privacy Act (CCPA) is a state law in California that grants California residents more control over their personal information that businesses are collecting. The CCPA puts in place new rules surrounding how companies collect, use, and store information about their consumers. Under the CCPA, businesses must provide information to consumers about what personal information they collect, how it will be used, and with whom it will be shared. Businesses must also give consumers the ability to opt out of having their data sold or shared with third-parties. Additionally, businesses must inform consumers of their right to access their personal data and delete it, and even request that a business stop collecting data altogether. The CCPA also creates new obligations regarding data security and breach notification. Any organization that collects personal information must put in place reasonable security measures to protect the data from misuse or unauthorized access. In the event of a data breach, businesses must notify affected individuals within 72 hours. The CCPA is applicable to any business that does business in California, collects personal data from California residents, or earns a gross annual revenue of more than $25 million. The law does not apply to data collected, sold, or disclosed pursuant to state or federal laws. In Mississippi, the data security law is known as the Mississippi Data Protection and Privacy Act.
