What is a data breach?

A data breach, also known as a data leak, is when someone maliciously or accidentally accesses and collects data without the permission of the owner or custodian of the data. In the case of Delaware, any organization that stores or holds data containing personal information of Delaware residents must comply with the Delaware Data Security Law. This law requires organizations to protect personal data from malicious access and to take swift action to contain any data breach that occurs. A data breach can include anything from a malicious hack, to a careless employee losing a laptop containing private data, to a data thief masquerading as an employee and gaining access to corporate systems. Regardless of the cause, a data breach is a major security issue and can put the privacy of the public at risk. Organizations must take steps to rapidly detect, respond to, and report any data breach in accordance with the Delaware Data Security Law. This requires implementing data security systems, conducting regular security reviews, and training personnel on how to respond to a data breach. Organizations should also create a privacy policy that outlines how personal data is collected and how it is protected. Following these guidelines will help organizations stay compliant with data security laws and protect their customers’ data from malicious access.
