What is the Children’s Online Privacy Protection Act (COPPA)?

The Children’s Online Privacy Protection Act (COPPA) is a federal law that was enacted in 1998 to protect the online privacy of children under the age of thirteen. COPPA imposes certain restrictions on operators of online services, and prohibits them from collecting any personal information from children without first obtaining verifiable parental consent. Under COPPA, operators must clearly post their privacy policies and must obtain consent from parents before collecting, using, or disclosing any personal information from children. The law also requires operators to provide parents with access to information collected from their children, as well as the ability to delete or refuse the further collection or use of their children’s information. In Florida, the Attorney General is responsible for enforcement of the COPPA, and has the authority to bring civil enforcement actions against those who violate the law. Additionally, any person who suffers actual damages or is adversely affected by a violation of the COPPA may bring a civil action against the violator. COPPA is a critically important protection for children’s online privacy, and is intended to help ensure that their private information is not collected and used inappropriately. It is important for parents to be aware of this law and to actively take steps to protect their children’s online privacy.
