What is the Health Information Technology for Economic and Clinical Health (HITECH) Act?
The Health Information Technology for Economic and Clinical Health (HITECH) Act is a federal law in the United States that was enacted in 2009 to improve the use and adoption of Health Information Technology (HIT). The HITECH Act promotes the adoption of electronic health records (EHRs), increases the security of electronic health record (EHR) systems, and increases the privacy and security of health information. The HITECH Act is meant to improve care delivery, reduce medical errors, and improve medical outcomes by providing secure access to electronic health records and other health information. In North Carolina, HITECH requirements are enforced through the North Carolina Department of Information Technology. North Carolina requires all HIPAA-covered entities to comply with the HITECH regulations, and any covered entity found to be out of compliance with HITECH may be subject to civil and criminal penalties. The HITECH Act also provides penalties for HIPAA violations, including fines and jail time for organizations that knowingly violate the law. These penalties can range from $100 to $50,000 per violation and up to 10 years in prison. This law helps ensure that health information is kept safe and secure, allowing citizens to trust the healthcare system.
