How is data security enforced?

Data security in Delaware is enforced primarily by state and federal laws. The State of Delaware’s Data Protection Act of 2001 sets out requirements for businesses to protect personal information. Business must store, process, and transmit any personal information in a secure manner. The federal government also enforces data security. In 2002, the Federal Trade Commission (FTC) issued the Safeguards Rule which requires large businesses to protect customer information. The FTC also enforces the Children’s Online Privacy Protection Act, which requires websites to post a clear privacy policy and obtain parental consent for collecting information from children under the age of 13. Failure to comply with data security laws can result in civil penalties or class action lawsuits. Violations of the Safeguards Rule can result in fines up to $16,000 per violation. There are also criminal penalties for those who deliberately misuse personal data, including jail time and large fines. When it comes to data security enforcement, it is important for business owners to act responsibly and comply with all applicable laws. They should create a written policy outlining their data security measures and regularly review their practices to ensure they are in compliance. Furthermore, any businesses that collect personal information should make sure their systems are updated with the latest security features and that employees are properly trained on data security measures.
