What type of license suspension can a person expect after a drunk driving charge?

In West Virginia, a person who is charged with a DUI (Driving Under the Influence) or DWI (Driving While Intoxicated) may expect a license suspension in addition to any other potential penalties which may result. If the driver is found to be at or above the legal limit of .08%, then the license suspension period can range from six months to one year. The driver may also be required to install an ignition interlock device (IID) in their vehicle. This device requires a driver to submit a breath sample prior to starting their vehicle. In some cases, the state of West Virginia may impose an administrative license suspension prior to any criminal proceedings taking place. This administrative license suspension is for a period of 45 days or longer, depending on the driver’s prior record and the severity of the infraction. In addition, if the driver is found to have caused property damage or physical injury to another person, then the license suspension period may increase to six months or longer. If the driver is under the age of 21 and is charged with a DUI or DWI, then they may have their license suspended for a period of one year. In some cases, the license may be completely revoked. In addition, the driver may be subject to additional penalties such as fines, jail time, community service, and/or alcohol counseling. Ultimately, the length of license suspension will vary depending on the specifics of the case and the driver’s prior record. As a result, those charged with a DUI or DWI are encouraged to consult with a qualified attorney who can provide more information on the potential penalties.
