What type of restitution is available in a drunk driving case?
In North Dakota, those found guilty of a drunk driving accident can be required to pay restitution to victims. This includes payments for past medical expenses related to the crash, as well as payments for future medical bills. It also covers lost wages, lost earning capacity, and other out-of-pocket expenses incurred as a direct result of the accident. Those found guilty may also be required to pay for the destruction of the other vehicle, or for the repair of any damaged property. If the victim has died, then restitution can include funeral expenses and payments for pain and suffering incurred by family members. In addition, North Dakota law requires those convicted of a drunk driving accident to make restitution for all other direct losses incurred by the victim, including the cost of damage to the person’s car, or any other property. The court will determine the amount of restitution based on the degree of the injury or loss suffered by the victim. In some cases, a separate restitution hearing may be scheduled to determine the amount of compensation due to the victim. In North Dakota, those convicted of drunk driving are also required to pay a Victim’s Compensation Fund assessment. The assessment is usually between $75 and $1000, and is paid into a fund that helps cover the costs of lost wages, medical expenses, and other expenses related to victims of drunk driving cases. The court will determine the amount of the assessment based on the severity of the injury or other losses.
