What kind of compensation is available for victims of drunk drivers?

In Florida, the victims of drunk drivers may be eligible to receive compensation through several different avenues. The victims may be able to pursue what is called “negligence compensation” which is when a person who has been injured due to the careless or reckless actions of another person can be compensated for their losses. So, if the person that was intoxicated was negligent in their actions and caused the accident, the victim can pursue a claim for negligence compensation from the at-fault party. In addition, if the at-fault driver was insured, the victim can pursue a claim from the at-fault driver’s insurance company. Depending on the amount and type of insurance the at-fault driver purchased, the victim may be able to collect compensation for medical bills, lost wages, pain and suffering, and other losses. Finally, the victim may be able to pursue a claim against the establishment that served the alcohol to the at-fault driver. Under Florida law, an establishment that serves alcohol may be held liable for providing alcohol to an obviously intoxicated individual, and if that individual then causes an accident, the establishment could be held liable for damages.
