Can a DUI conviction be expunged from my record?
In Oregon, it is possible to have a DUI conviction expunged from your record, but it requires meeting certain criteria. Expunging a DUI conviction means that it is erased from public view and is no longer visible on background checks. To be eligible for expungement, certain requirements must be met. First, the conviction must have occurred at least three years prior to the petition. Second, you must not have any pending criminal charges in Oregon or any other state. Third, you must not have any other misdemeanor or felony convictions. Finally, you must not have any additional DUI convictions. If you meet these criteria, you will need to file a petition for expungement with the court. The process can be lengthy and costly. In Oregon, it typically takes three to four months for the petitioner to receive a response from the court. Depending on the court, the petitioner may need to attend a hearing, provide evidence in support of the petition, and pay certain fees. Once the expungement has been approved by the court, the original conviction will be removed from public view. However, the conviction will still show up on certain criminal history searches. Expungement does not provide someone with a clean slate; instead, it is meant to provide the petitioner with a fresh start.
