What are the rights of a person charged with a DUI?
In Arizona, a person charged with driving while under the influence (DUI) has several rights and protections. First and foremost, every person has the right to remain silent and not incriminate themselves. This means that a person charged with DUI does not have to answer any questions related to the incident or provide any information. Additionally, a person charged with a DUI must be informed of their Miranda Rights, which include the right to legal counsel and the right to a fair trial. A person has the right to hire an attorney to represent them in court and the right to a jury trial if desired. The Fifth Amendment also grants persons charged with DUI the right "not to be forced or compelled in any manner to incriminate oneself." The accused has the right to petition a court for a reduction or dismissal of charges, or for diversion, or to enter a plea of Not Guilty. A person charged has the right to see all evidence pertaining to the case. Other rights include the right to confront witnesses, the right to appeal the court’s decisions, and the right to fully understand the charges they are facing. By understanding their rights, the accused can make informed decisions concerning the case.
