What is the difference between a first-time and a repeat DUI offense?
In Oregon, a DUI (Driving Under the Influence) offense is considered a criminal offense. The difference between a first-time and a repeat DUI offense in Oregon is, typically, the severity of the punishment. For a first-time DUI offense, an offender may face a court-ordered license suspension for one year, up to one year in jail, fines, and, potentially, an ignition interlock device (IID) in their vehicle. Depending on the circumstances, some first-time offenders may also face vehicle impoundment. With a repeat DUI offense, the punishment increases in severity. The offender will likely have their license suspended for three years, face a mandatory minimum jail sentence of at least 48 hours, larger fines, and longer vehicle impoundment periods. A repeat DUI offender may also be required to get an IID installed on their vehicle for up to two years. The laws surrounding DUI offenses and punishments in Oregon are very serious. In addition to the punishments listed above, offenders of any kind of DUI offense may also face court-ordered counseling, community service, and/or probation. The punishment for a DUI offense may vary and may increase depending on the severity of the incident.
