Yes, there are several legal alternatives to a jail sentence for a DUI charge in Florida. Florida law allows for a probationary period in lieu of a jail sentence for a DUI charge. This probation period is usually negotiated between the defendant and the prosecuting attorney. In most cases, the probation period involves an acknowledgement of guilt by the defendant and the payment of a fine, successful completion of an alcohol assessment, drug and/or alcohol testing, attending a DUI school, community service or a combination of all of these requirements. The driver may also be ordered to lose their driving license for a period of time and, depending on the severity of the DUI, the driver may be required to install an ignition interlock device (IID). This device is installed on the driver’s vehicle and requires a breath test before the vehicle can be started. If the driver fails the breath test, the vehicle will not start. In some cases, a defendant may be eligible for a deferred adjudication which allows them to avoid a formal conviction. This requires the defendant to enter into an agreement with the court or probation officer to complete certain conditions, such as completing an alcohol or counseling program or participating in community service. If the defendant successfully completes their probationary requirements, the court would then dismiss the charge. Lastly, the court may also consider a suspended sentence for a DUI charge. This simply means the defendant will not have to serve jail time provided they meet certain probationary requirements. This allows the court to drop the charge from the record after the period of probation is complete.
