What is debt collection law?
Debt collection law is the legal framework that governs the activities of debt collectors in Florida. Debt collectors are companies and individuals that attempt to collect money from individuals who owe money on unpaid bills, such as credit card debt, medical bills, and other debts. Debt collection law regulates the actions that debt collectors may take when attempting to collect a debt. Debt collection law in Florida requires debt collectors to treat debtors fairly, and prohibits certain unfair and deceptive collection practices. Debt collectors must identify themselves accurately, honor their commitments, provide accurate information about the debt, and not harass or threaten debtors when trying to collect. Debt collectors are also required to provide debtors with a written notice that they are attempting to collect a debt, and a copy of the original debt agreement. Debt collection law also allows debtors to challenge the accuracy and validity of a debt that a debt collector is trying to collect. Debtors have certain rights that they can exercise to protect themselves from abusive debt collection practices. For example, a debtor can file a complaint with the Florida Office of Financial Regulation if they believe that a debt collector has violated debt collection law. Debt collection law is designed to protect both debtors and debt collectors. It allows debt collectors to collect legally owed debts, while also ensuring that debtors are treated fairly and with respect.
