What methods can a debt collector use to collect a debt?
A debt collector in Washington must adhere to state and federal laws, as well as the Fair Debt Collection Practices Act, when attempting to collect a debt. Generally speaking, a debt collector can use a variety of communication methods to seek repayment. The most common method is direct communication by phone, mail, or email. If contact is made by phone, the collector must identify themselves and the reason for the call. They must also provide a written notice of debt within five days of the initial call. The notice should identify the amount due, the creditor’s name and address, and the collector’s name and address. If a payment plan has been proposed, the collector can send reminders to the debtor about due dates or unpaid amounts. If a payment plan is not agreed upon, the collector may refer the debt to a lawsuit. It is also possible for a collector to contact the debtor’s employer to ask them to garnish the debtor’s wages, or to contact family or friends to inquire about the debtor’s financial situation. If the debt collector does not follow the applicable laws, the debtor can file a complaint with the Consumer Financial Protection Bureau. The goal of the debt collector should be to work with the debtor to come up with a payment plan that is achievable, and to treat the debtor with respect.
