Can a debt collector ever contact me more than once a week?
In California, debt collectors may contact you no more than once a week, per the Fair Debt Collection Practices Act. This law was passed to protect consumers from harassing or abusive debt collection correspondence. It also restricts debt collectors from calling you too frequently or at inconvenient times, such as in the early morning or late at night. Once a debt collector contacts you, they can only reach out once per week. However, additional contact can occur if the collector believes they have new information or the consumer has requested additional information. If the consumer requests additional contact, the collector can contact them twice a week. If the debt collector leaves messages with a third-party, such as a family member, neighbor, or co-worker, the collector can contact that person once every week until the consumer’s contact information is updated. Lastly, if a consumer sends a written request for the debt collector to stop calling, the collector must cease all contact with the consumer. The law also states that the consumer must be allowed to communicate with the debt collector using any form of communication that is allowed by law. In conclusion, debt collectors in California are legally allowed to contact consumers no more than once a week, unless the consumer requests more contact or additional new information is available. If the consumer sends a written request to cease calling, the collector must stop all contact.
