How long can a debt collector attempt to collect a debt?

In Oregon, the length of time a debt collector can attempt to collect a debt is determined by the statute of limitations. The statute of limitations for debt collection in Oregon is six years from the date of the last payment or recognition of the debt, whichever is later. This means that any debt not paid or partially paid on or after the date of the last payment or recognition of the debt can still be collected after six years. Oregon law also permits debts to be collected after six years provided certain conditions are met. The debt collector must provide written notice to the debtor that the debt is beyond the statute of limitations and that the debtor should not pay the debt. The notice must state that payment of the debt would restart the statute of limitations and would allow the debt collector to sue the debtor for the unpaid balance. Debt collectors who continue to attempt to collect a debt after the statute of limitations has expired may be subject to legal action. Oregon debt collection laws also provide for damages and attorney fees for successful cases against a debt collector who violates the statute of limitations. In summary, in Oregon, debt collectors have six years from the date of the last payment or recognition of the debt to attempt to collect it. If the debt collector continues to try to collect the debt past this period, the debtor may be able to sue the debt collector for damages.
