Can a debt collector contact me at any time of day?
In California, debt collectors must follow the law when it comes to how and when they can contact you. The Fair Debt Collection Practices Act (FDCPA) states that debt collectors cannot contact you before 8am or after 9pm, unless you have given them permission to do so. They also cannot contact you at work if you have told them not to. Another important aspect to consider is whether or not the debt collector is licensed to do business in California. If not, then the FDCPA may not apply and the debt collector may be able to contact you at any time of day. In addition to the FDCPA, California laws also have time restrictions on debt collectors. These laws limit debt collection calls to three per week and prohibit them from harassing or intimidating you in any way. In general, debt collectors in California cannot contact you outside the hours of 8am to 9pm. This applies to phone calls, letters, emails, and text messages. So if a debt collector is trying to contact you outside of these hours, it is likely a violation of your rights and you should contact a consumer protection attorney.
