Does defamation law protect celebrities or public figures?
Yes, Colorado defamation law does protect celebrities and public figures. This protection is due to the fact that celebrities and public figures have unique needs because of their exposure to the public. Under Colorado defamation law, for a celebrity or a public figure to get a successful judgment they must prove that the statement made was false, that the statement caused them “actual harm”, and that the person who made the claim acted with actual malice, meaning that they knew the statement was false and still intentionally made it. Unlike private figures, celebrities and public figures must show that the statement made was false and that it caused actual harm. Furthermore, celebrities and public figures must also be able to show that the statements were made with malice. In Colorado, malice can be proven by showing that the person making the statement was reckless in doing so. This means that the person making the statement either disregarded the potential that what they were saying could be false or did not take reasonable steps to ensure that the statement was true. In conclusion, Colorado defamation law does protect celebrities and public figures from those making false statements. As a result, these individuals are entitled to legal protection from those who make false and malicious claims about them in the public space.
