How does a person prove that the defendant was negligent in publishing false and defamatory statements?

In Oklahoma, a person must prove that the defendant was negligent in publishing false and defamatory statements in order to have a successful defamation suit. To do so, the plaintiff must present evidence to support their claim of negligent behavior. Negligence is defined as the failure to exercise reasonable care, which could result in foreseeable harm to another person. The plaintiff must be able to prove that the defendant acted unreasonably when publishing the false and defamatory statements. Factors that may be used to determine if a defendant acted negligently include the following: whether the defendant took adequate steps to verify the accuracy of the information they published; if the defendant acted with malice; and if the defendant had a financial, personal, or professional motive for publishing the information. In Oklahoma, the plaintiff must also be able to prove that the false and defamatory statement caused them to suffer damages. Examples of such damages can include loss of reputation, emotional distress, financial losses, and physical harm.
