What are the remedies available in a defamation lawsuit?

In South Dakota, a successful plaintiff in a defamation lawsuit may be entitled to several types of remedies. Generally, the court will award either compensatory damages and/or punitive damages. Compensatory damages are intended to make a person “whole” from a financial standpoint. These damages may cover such economic losses as medical costs, lost wages, and loss of property. Punitive damages, on the other hand, are designed to punish a defendant for his or her malicious or willful behavior. In addition to damages, a court may grant a plaintiff an injunction in a defamation lawsuit. An injunction is a court order that prohibits the defendant from publishing the statement or engaging in the same type of conduct in the future. It is the court’s way of preventing the defendant from repeating the same actions against the plaintiff or others. Finally, the plaintiff can also seek a remedy known as “declaratory relief” in a defamation lawsuit. This means that the court declares a statement to be false or illegal, and the plaintiff is not liable for any damages related to the statement. Overall, a successful plaintiff in a defamation lawsuit may be entitled to compensatory damages, punitive damages, an injunction, and/or declaratory relief in South Dakota. It is important to speak to a qualified attorney to determine which remedies are available in a particular case.
