How do I file an ADA complaint?
If you believe that you have been wrongfully discriminated against due to your disability in North Dakota, you may file a complaint with the U.S. Department of Justice (DOJ). The DOJ enforces the Americans with Disabilities Act (ADA) which protects people with disabilities from discrimination in the workplace and in public places. To file a complaint, you can contact the DOJ’s Office for Civil Rights (OCR) and request a complaint form. The form will typically ask for information about the discrimination you experienced, such as when and where it occurred and any relevant details. Once you submit the complaint, the OCR will investigate the claim. If they find that discrimination has occurred, they may take appropriate action, such as ordering the responsible party to stop the discrimination and take steps to prevent it from happening again. If you would rather not file a complaint with the OCR, you may be able to file a private lawsuit against the responsible party instead. To do this, you must be represented by a lawyer. The lawyer can help you understand the laws that apply to your situation and make sure that your case is handled properly. No matter which option you choose, it is important to understand your rights and responsibilities under the ADA. If you have any questions about the ADA or filing a complaint, you can contact the Disability Law Center of North Dakota for assistance.
