What are my rights as a disabled employee?
In North Carolina, disabled employees have certain rights in the workplace that are outlined by the Americans with Disabilities Act (ADA). The ADA prohibits employers from discriminating against individuals with disabilities in all areas of employment, including hiring, training, promotion, job assignment, pay, fringe benefits, and other terms or conditions of employment. Employers must make reasonable accommodations for employees with disabilities. This means employers must make changes to processes and to the physical workspace to allow disabled employees to work to the best of their abilities without facing undue hardship. Examples of accommodations might include providing a wheelchair ramp, adjusting a work desk to a more comfortable height, or providing assistive technology or devices. In addition, employers cannot ask applicants or employees questions about their disabilities or medical conditions. Employers also cannot require that an employee submit to medical examinations, unless such examinations are required by other applicable laws. Furthermore, employers may not illegally fire, refuse to hire, or otherwise discriminate against employees with disabilities. If an employee believes they have been discriminated against or are in need of accommodations, they can contact the North Carolina Department of Labor to file a complaint. In addition, disabled employees may be entitled to certain government benefits, such as Social Security Disability Insurance (SSDI).
