What are my rights as a disabled employee?

As a disabled employee in Virginia, you are covered and protected under federal disability law. This law is called the Americans with Disabilities Act or ADA. Under the ADA, employers cannot discriminate against you because of your disability. Employers must make reasonable accommodations to allow you to perform the essential functions of your job. In addition, Virginia has its own laws that protect the rights of disabled employees. The Virginia Human Rights Act (VHRA) and the Virginia Workers’ Rights Act (VWRA) are two major laws that provide protections for disabled employees. The VHRA prohibits employers from discriminating against you on the basis of your disability in any area related to employment, including hiring, promotions, and wages. The VWRA requires employers to make reasonable accommodations so that you can do your job. In both cases, you have the right to request reasonable accommodations from your employer if you need them and your employer is required to provide them. To make a request, you should talk to your supervisor or a Human Resources representative about what accommodations you need. If your request is denied, you may want to seek the advice of a lawyer who specializes in disability law.
