What is the Americans with Disabilities Act Amendments Act of 2008?
The Americans with Disabilities Act Amendments Act of 2008 (ADAAA) is a law that strengthens the protections of the original Americans with Disabilities Act of 1990 (ADA). It was passed by Congress in 2008 and signed into law by President George W. Bush. The purpose of the ADA is to make sure that people with disabilities have equal access to employment, public accommodations, transportation, and government services. The ADAAA amended the ADA in several important ways. It expands the definition of who qualifies as “disabled” under the law to include those who have impaired ability to perform normal life activities. The Act also makes it easier for an individual to prove that disability status. Additionally, the ADAAA removes the requirement that individuals must prove they are significantly limited in more than one life activity. The ADAAA also protects individuals from discrimination in the workplace. It reinforces the existing protections for people with disabilities under the ADA and clarifies the provisions related to reasonable accommodations in the workplace. This means employers are required to provide reasonable accommodations for an employee with a disability, so long as it does not impose an undue hardship on the employer. In South Carolina, the ADAAA is enforced by the South Carolina Human Affair Commission. The Commission is responsible for investigating and resolving any complaints of discrimination against individuals with disabilities. They provide resources and assistance to individuals with disabilities, as well as employers and other organizations involved in disability law.
