What is the Americans with Disabilities Act Amendments Act of 2008?

The Americans with Disabilities Act Amendments Act of 2008 (ADAAA) is a federal law that makes it easier for people with disabilities to be protected from discrimination under the Americans with Disabilities Act of 1990 (ADA). The purpose of the ADAAA is to provide additional protections against discrimination for individuals with disabilities. In Virginia, the ADA and ADAAA provide protection against discrimination in employment, public services, public accommodations and transportation, as well as communication and miscellaneous activities such as religion and voting. The ADAAA also expands the definition of disability to include “a physical or mental impairment that substantially limits one or more major life activities.” This is a broader definition than the ADA and offers more protection against discrimination for people with various disabilities, including conditions that may not have been considered “disabilities” before the ADAAA. The ADAAA also requires employers to provide reasonable accommodations to job applicants and employees with disabilities. This includes modifications to the physical environment, job duties, and equipment to allow individuals with disabilities to perform their job functions, as well as providing accessible technological resources. The ADAAA also prohibits employers from asking questions about an individual’s disability or medical condition before an offer of employment is made. This is to ensure that an individual’s disability status does not affect their ability to get a job or to keep one. In Virginia, all employers are responsible for carrying out the requirements of the ADA and ADAAA and must take steps to provide a workplace free of discrimination and harassment.
