What are the eligibility requirements for the Americans with Disabilities Act?
The Americans with Disabilities Act (ADA) is a federal law that protects people with disabilities from discrimination in employment, public services, public accommodations, and telecommunications. In North Carolina, the ADA applies to employers with at least 15 employees, state and local governments, and private businesses providing services to the public. To be eligible for protection under the ADA, an individual must have a physical or mental impairment that substantially limits one or more major life activities. This includes activities like walking, seeing, speaking, breathing, learning, and working. Also, the individual must have a record of such an impairment or be regarded as having such an impairment. Additionally, the ADA prohibits employers from discriminating against qualified individuals with disabilities. To be considered a qualified individual with a disability, the person must be able to perform the essential functions of the job they are applying for, with or without reasonable accommodation. An employer also cannot discriminate against an employee because of their association or relationship to an individual with a disability. Finally, the ADA requires public services, public accommodations, and telecommunications services to be accessible to individuals with disabilities. Public services, publicly funded transportation, and places of public accommodation must be readily accessible to, and usable by, individuals with disabilities. Telecommunications services must also offer services that are accessible to individuals who are deaf or hard of hearing.
