What is the reasonable accommodation process?

Reasonable accommodation is a process designed to protect people with disabilities in Hawaii from discrimination in the workplace and other areas of life. The process requires employers to make modifications to the workplace or its procedures, when necessary, to enable people with disabilities to work and to participate fully in their communities. The process starts when an individual with a disability requests an adjustment in order to accommodate his or her disability. A request for reasonable accommodation should include as much information as possible about the individual’s needs, so the employer can identify a reasonable accommodation. After considering the request, an employer should discuss the requested accommodation with the individual and consider available options. If the requested accommodation is found to be reasonable, the employer must provide it, unless it would cause an undue hardship on the employer. The employer can ask the individual to provide documentation from a healthcare provider that the accommodation is necessary. An employer also has the right to request that the individual provide additional information about the disability and its impact on the individual’s need for an accommodation. Once an accommodation is provided, it can be adapted or amended as needed to adjust to changing circumstances. The employer should also keep up communication with the individual to ensure that the accommodation is working. Through the reasonable accommodation process, people with disabilities in Hawaii can get the necessary support they need to live, work, and participate in their communities.
