How is spousal support and alimony determined?

In Indiana, spousal support and alimony are determined based on a variety of factors, with the overarching goal of providing for a fair and equitable outcome that is in the best interests of both parties. When a court evaluates spousal support or alimony, it will consider several factors such as each spouse’s income, assets, earning potential, and need. The court may also consider the length of the marriage, each spouse’s age, health, and standard of living during the marriage. The court may also take into account the contributions made by each spouse to the marriage, both in terms of financial contributions as well as contributions of “services” or non-monetary contributions. In addition, the court may consider the amount of each spouse’s separate property (property owned before the marriage or acquired through inheritance), and whether either spouse has dissipated or misappropriated any of the couple’s shared property. Ultimately, the court will assess each spouse’s need for spousal support or alimony, taking into consideration all of the above factors. If spousal support or alimony is ordered, the court will also determine the appropriate amount and duration of the support. In most cases, the amount of alimony or spousal support will be based on the financial needs of the spouse who is receiving it and the other spouse’s ability to pay.
