How is spousal support and alimony determined?

In Oklahoma, spousal support or alimony is generally determined by the court on a case-by-case basis. The court will consider a number of factors including the income and earning potential of each spouse, the length of the marriage, the age and health of each spouse, and the contributions each spouse made to the marriage. The court will also take into consideration any agreements or contracts that both parties may have signed during the marriage and any debts or property that needs to be divided between the spouses. The court may look at standards such as the Uniform Marriage and Divorce Act or may use its own discretion to determine the amount of spousal support to be paid. The court may also consider the financial resources of both spouses, as well as the potential for future employment or other means of income. It may grant temporary spousal support to assist one spouse while they become financially stable. In some cases, the court may order the payment of a lump sum payment or may order the payment of periodic payments over a certain period of time. These payments may be awarded for a specific purpose, such as for medical expenses or for the purchase of a home, or they may be awarded to provide a supplemental income. Spousal support and alimony can be modified at any time if there is a substantial change in circumstances.
