What is the difference between an uncontested and contested divorce?

An uncontested divorce is one in which both parties involved agree to all of the divorce-related terms and conditions presented to them. This type of divorce is typically less time consuming, cost effective, and psychologically less taxing as there is no need to draw out the proceedings through a court trial. An uncontested divorce typically requires the least amount of paperwork and results in a final judgement within a few months. On the other hand, a contested divorce is one in which the two parties involved disagree on some or all of the divorce-related issues such as child support, alimony, division of property, and spousal maintenance. In this situation, a mediator or a judge is brought in to hear both parties’ arguments and to make a final ruling. This type of divorce often takes longer than an uncontested divorce, as it usually requires several court hearings and further appearances which can drag out the divorce proceedings. In Indiana, both types of divorce proceedings will require that you meet certain legal requirements. Additionally, you must file the proper paperwork and obtain a marriage dissolution decree from the court before the divorce will be finalized.
