What are the steps in the divorce process?

In Maryland, the divorce process requires that both spouses comply with the law. The first step is that one spouse must properly serve the other spouse with a Complaint for Divorce. The Complaint must contain the facts and grounds for the divorce petition. Once served, the other spouse has 30 days to respond and file an Answer. If there are any disagreements over the facts or other issues such as child custody and alimony, the spouses may attempt to resolve the differences by negotiating a settlement agreement. If the parties are unable to reach an agreement, the matter will proceed to court. During this time, each spouse may request temporary orders to address things like spousal support and child custody while the divorce is pending. After the temporary orders are entered, the court will proceed to a trial or hearing. During this time, the court will consider evidence submitted by both sides and make a decision regarding the divorce. Once the divorce is granted, the court will enter a final decree of divorce which will dispose of all of the issues in the case. Lastly, the court will issue an order which will allow the divorce to become final. This is what will officially end the marriage and allow the spouses to finalize the division of assets and debts and other related matters. After the divorce is finalized, the spouses will be legally single.
