Where do I file for divorce?

In Maryland, the process of filing for divorce is called “dissolution of marriage” and it is an action that is filed in the circuit court for the county where either the petitioner or the respondent resides. It is important to note that if either party does not live in Maryland then the petition for dissolution of marriage cannot be filed in the state. In order to file for divorce, the petitioner must fill out a Complaint/Petition for Absolute Divorce form (Form D-13) and pay a filing fee. The court will issue a summons that must be served upon the respondent as notification of the divorce proceedings. Once the summons is served, the respondent is required to file a response with the court as well as an answer to the petitioner’s complaints. Once the completed forms are filed with the court, the court will schedule a hearing and may issue temporary orders until the case is heard. If the parties can reach an agreement, then a Final Divorce Decree will be issued. If there is not an agreement, then the case will go to trial and the court will make a decision about issues such as child custody, spousal support, and division of property.
