What is a divorce decree?
A divorce decree is a court order that legally terminates a marriage and establishes the rights and responsibilities of each party following the divorce. In Rhode Island, a divorce decree will be included in a final judgment or decree of divorce. This document is issued by the court and will include the court’s rulings on divorce-related issues, such as the division of assets and debts, child custody arrangements, alimony payments, and any relevant other provisions and/or orders. The divorce decree will provide the details of how the parties must proceed after the marriage is officially dissolved, such as dividing assets and debts, making alimony payments, and establishing child support payments. This document will also list any restrictions or limitations that have been placed on the parties as a result of the divorce. This includes restraining orders or stipulations limiting contact between the parties. In Rhode Island, the process of obtaining a divorce decree typically begins with the filing of a complaint for divorce. This is followed by a period of discovery during which both parties gather evidence and information relevant to their case. When the discovery period is complete, the parties can enter into negotiations to settle their divorce. If negotiations don’t produce an agreement, the case will proceed to trial and the court will decide all issues related to the divorce. The court’s ruling will be included in the divorce decree.
