What is a divorce decree?
A divorce decree, or final divorce order, is a document issued by a court that officially ends a marriage. In South Carolina, the court must enter this decree in order to make the divorce legal. The decree will include the final decisions of the court on matters such as property division, child custody, child support and alimony, if applicable. It will also specify the date of the marriage’s dissolution. Typically, the judge will issue the divorce decree once all issues associated with the divorce have been finalized. This includes all matters related to child custody, asset distribution and other general financial matters. In South Carolina, if the couple is unable to reach an agreement on the divorce matters, the judge will issue the divorce decree after a trial or other formal hearing. Though the divorce decree is the final document of the divorce, it is possible for the parties to modify it later if the circumstances change. In the event that modifications are necessary, the court may issue a new order that supersedes the divorce decree. It is also possible for the parties to mutually agree to alter the decree without the court’s involvement. For instance, if the couple agrees to an alteration of the decree regarding childcare arrangements, they can make the change without having to go back to court.
