What is a divorce decree?

A divorce decree is a court document issued by a judge to officially terminate a marriage. In West Virginia, a divorce decree is also known as a final decree of divorce. This document is the legal proof that the marriage no longer exists. The divorce decree will outline the terms of the divorce, such as child custody, visitation rights, alimony payments, division of property, and child support. It also states the date the marriage is officially over and the date when the final decree was issued. It can also address any other issues that were discussed during the divorce proceedings, such as any agreements between the parties regarding the payment of debts. The divorce decree can be modified at any time, but only with the approval of the courts. If the parties cannot agree on any terms, they can return to court for a hearing to settle their differences. The parties may also choose to appeal the divorce decree if they believe the court made a mistake in awarding a certain asset or ruling on an issue. The appeal must be filed within 30 days of the final decree being issued. Once the divorce decree is issued, it is the legal proof that the marriage is no longer valid, and the parties are legally free to remarry. It is important for both parties to abide by the terms of the divorce decree to avoid any further legal issues.
