How do I modify a divorce decree?
In Indiana, you can modify a divorce decree by filing a petition with the court in which your original divorce decree was entered. The petition must explain why the decree needs to be modified and how your circumstances have changed since the original decree was issued. For example, if you are the custodial parent and your income has changed significantly since the original decree, you can file a petition to modify the financial support that is required of the non-custodial parent. Once the petition is filed, the court will schedule a hearing to consider whether the petition should be granted. At the hearing, both the petitioner and respondent will be allowed to present evidence to the court to support their argument. The court will consider the evidence and determine whether to grant or deny the petition. If the court grants the petition, the modified decree will then become a court order that must be followed by both parties. In some cases, the modification may be uncontested and both parties can agree to the changes without a court hearing. If this occurs, the parties can sign an agreement or consent order that states the modifications and have it filed with the court. The agreement will then become a court order that must be followed by both parties. Modifying a divorce decree is a complex process and can be confusing and difficult. It is important to seek the advice of an experienced lawyer to avoid any potential issues that may arise from modifying the decree.
