What is collaborative law?

Collaborative law is a process of divorce and family law designed to help couples end their marriage without going to court. Instead, the couple focuses on reaching an agreement through a series of private negotiations. Divorcing couples who decide to use the collaborative law process are typically represented by attorneys trained in collaborative law. The attorneys draft up a Participation Agreement and sign it, agreeing to work with each other and the couple to reach a resolution in an efficient and cost-effective manner without going to court. During the collaborative law process, the couple and their attorneys meet and work together to negotiate a settlement that meets both parties’ needs and interests. During the meetings, the couple and their advocates work together to develop creative solutions to complicated areas of divorce, such as finance, child custody, division of assets, and more. The process usually takes place in a series of four to five meetings which take place over several months. The collaborative law process is designed to not only save time and money, but also to ensure that the couple communicates with each other in a respectful manner and that the entire process is conducted in a private setting. It allows either party to be represented by an attorney who can provide the necessary legal advice and insights while also working to ensure that the process is fair for both spouses.
