What is a pendente lite order?

A pendente lite order is a legal order issued by a court requiring parties involved in a divorce to adhere to specific guidelines until the divorce is finalized. This type of court order is typically issued in North Dakota when one of the parties files for divorce and the case is yet to be decided. A pendente lite order may be requested by either party to the divorce, and is usually used to regulate the parties’ conduct and financial interactions while the divorce is pending. The order may prohibit either party from moving out of the marital home, transferring or disposing of assets, or doing other activities without the other party’s consent. In addition, a pendente lite order may also provide for temporary child support and/or spousal support. The purpose of a pendente lite order is to protect the rights of the parties involved and to maintain the status quo until the divorce is finalized. This type of order is issued as a temporary measure and is binding on both parties until the court issues a final ruling. The pendente lite order will remain in effect until the divorce is either resolved through an agreement or finalized by a court.
