What is a stipulation of settlement?

A stipulation of settlement is a legal document filed with the court in a Maryland divorce case. It is an agreement between the parties to resolve all issues related to the divorce. The stipulation of settlement will contain the parties’ agreement on asset and debt division, alimony (spousal support), child custody and visitation, child support, attorney’s fees, and any other issues relevant to the divorce. It will also include the terms of the final divorce, such as a date for the divorce to become final. After negotiating the terms of the settlement, the parties will then meet with a mediator or an attorney to draft the stipulation. This document is then filed with the court, and the parties will appear before a judge who will review the document and ensure it is fair. Once the judge approves the settlement, they will entered an order of dissolution of marriage, which officially ends the marriage and requires the parties to follow the terms of the stipulation. It is important to note that while the court will review the stipulation of settlement to ensure it is fair, the parties are ultimately responsible for the agreement they have made. Therefore, it is essential that each party fully understands what they are agreeing to before signing the document. Additionally, if new issues arise after the stipulation is filed with the court, the parties may need to renegotiate and file a new agreement.
