What documents do I need to file for a divorce?
In Kansas, the documents needed to file for a divorce are a Petition for Divorce, a Summons, a Certificate of Service, and a Preliminary Injunction. The Petition for Divorce is a document filed by the person who is seeking the divorce. It will include the reasons the divorce is being requested, as well as any requests the person may have regarding child custody, spousal support, and the division of property. The Summons then allows the other spouse to be notified of the divorce and gives them the opportunity to respond. The Certificate of Service is a confirmation that the other spouse was properly served with the Petition for Divorce and Summons. The Preliminary Injunction is an order from the court that orders both parties to maintain the status quo until the divorce proceedings are completed. This means that both parties must not try and change any financial arrangements, such as taking on additional debt or transferring assets, without the permission of the court. In addition to the documents outlined above, you will also need to provide proof of residence, a valid driver’s license or other valid photo ID, any marriage or divorce certificate, any birth certificates of children, and a copy of your most recent tax return. All these documents must be filed with the court in order for the divorce proceedings to begin.
