How is child custody determined?
In the state of Washington, child custody is determined based on the best interests of the child. Custody is generally split between both parents, and will be determined by considering factors such as the age of the child, the financial stability of the parents, the mental and physical health of both parents, the preferences of the child, and the desires and abilities of both parents. The court may also look at the relationship between the child and each parent, the willingness and ability of the parent to provide for the child’s physical and emotional needs, and the child’s current home environment. The court may also take into consideration any history of abuse in the home, any special needs of the child, and any other relevant factors. The court will usually try to create an arrangement which allows the child to have frequent contact and ongoing meaningful interactions with both parents. In some cases, the court may order that the parents need to attend a mediation session or other meeting to discuss and come to an agreement regarding custody before the court will make a decision. In the end, the court may grant joint legal custody or sole legal custody to one parent. Joint legal custody means that both parents are equally responsible for making decisions regarding the health, education, and welfare of the child. On the other hand, sole legal custody entitles one parent to make the decisions regarding the child’s care. Physical custody may be granted to one or both parents, and for this, the court will consider the child’s needs in regards to stability and continuity.
