What is a mediation divorce?

A mediation divorce is a form of alternative dispute resolution (ADR) for couples who wish to end their marriage. It is an alternative to a traditional court-based divorce, which can be expensive and time-consuming. In a mediation divorce, a neutral third-party mediator assists the couple in coming to an agreement on all of the issues related to their divorce, such as division of assets, child custody, and alimony. The mediator helps the couple to negotiate a settlement that works for both of them. In Massachusetts, either party can initiate mediation through a mediator certified by the Massachusetts Council on Family Mediation (MCFM). The couple would then meet with the mediator to discuss their goals and options. The mediator will help the couple to negotiate a settlement and will draft the settlement agreement to be signed by the parties. Once both parties have signed the settlement agreement, the mediator will then submit it to the court for approval. After the court approves the settlement agreement, both parties will have a legally binding divorce. The process is often faster and less expensive than a court-based divorce, and may be less adversarial, as the parties negotiate their own agreement.
