What is a mediation divorce?

A mediation divorce is a popular alternative to the traditional divorce process in Oklahoma. Mediation is a form of alternative dispute resolution (ADR) where a neutral third-party mediator helps both parties come to an agreement. The goal of a mediation divorce is to facilitate a cooperative divorce without courtroom proceedings. The mediation process begins when both parties agree to attend mediation sessions facilitated by a mediator. The mediator will work with the parties to identify and discuss the issues in the divorce, such as division of property and debt, alimony, and child custody. The mediator will encourage both parties to consider creative solutions and reach a compromise. The mediated agreement must be approved by the courts and is legally binding. In Oklahoma, the mediator will also provide a court report outlining the details of the mediated agreement. If either party is unsatisfied with the agreement, they can take the issue to court where a judge will make a ruling. Mediation divorce is usually less expensive and less stressful than other types of divorce. It can also reduce the amount of time it takes for the divorce to be finalized. Mediation divorces are especially popular in Oklahoma, which has no-fault grounds for divorce and requires divorcing couples to attend mediation.
