What is a prenuptial agreement?

A prenuptial agreement (often referred to as a “prenup”) is a legal document that couples sign before they are married. This document lays out how their assets and other material possessions will be divided should they decide to get a divorce. It can also include specific decisions about how property, debts, and alimony should be handled if the marriage were to end. Prenuptial agreements are especially important for couples in Kansas, as the state follows “equitable distribution” law when it comes to divorce and property division. In equitable distribution states, the court will evaluate the marital assets and liabilities, and then decide how to divide them in a fair and equitable manner. Prenuptial agreements can help protect each partner’s rights and interests by establishing the rules for this process and defining what each partner is entitled to in the event of a divorce. Prenuptial agreements must follow certain formalities in order to be legally binding and enforceable in Kansas, including having both parties sign the agreement in front of two witnesses, and having both parties have their own lawyers to provide legal advice. Additionally, it should be noted that prenuptial agreements must be fair and equitable to both partners. If a prenuptial agreement is found to be unfair or invalid, a court may reject it and the division of marital property could be decided under the court’s equitable distribution rules.
