What is a child support modification?

A child support modification is a legal change to an existing child support order. This change is typically requested by one or both parents when circumstances surrounding the child and/or family have changed since the original order was set. In California, the process of a child support modification begins with the filing of a Request for Order with the court, in which the parent is seeking the modification. Once the Request for Order is filed, a hearing will be scheduled and both parents will have the opportunity to present evidence in favor of or against the modification. Once the hearing is complete, the court will make a decision based on the best interests of the child and other evidence presented. This decision will include the agreed-upon amount of child support, as well as any other modifications that may be necessary. These modifications typically cover topics such as visitation, medical expenses, and educational expenses. It can also include provisions regarding how funds and assets are divided. A child support modification is an important legal tool useful in providing adequate care and support for the child in light of changes in the lives of the parents. It is important to obtain knowledgeable legal counsel if you are considering pursuing a child support modification in the state of California.
