What is a child support modification?

A child support modification is a process of legally changing the amount or other terms of a child support arrangement. This process generally applies to court-ordered child support agreements; however, agreements made between two people outside of a court of law can also be modified. In Oklahoma, if either parent experiences a significant change in income or other factors, they may be able to modify the child support amount. This includes changes in income, changes in health insurance, changes in the cost of childcare, or if a parent’s income changes to a point where the previous child support amount is no longer reasonable. Either parent can file a Petition for Modification with the court, or they can agree to an arrangement outside of court. If both parents agree to a direct modification, they must have it approved and signed by the court. If they cannot agree, the court will make the decision. In Oklahoma, the court may order a child support modification if it’s in the best interests of the child. The court takes into consideration a variety of factors when making a decision such as the health and education of the child, the incomes of the parents, and the needs of the child. Child support modifications must be approved by the court to be legally binding, so it’s important to follow the rules and regulations set by the state. If a parent fails to fulfill the terms of a modification, they may be found in contempt of court and face serious consequences.
