What is a legal separation agreement?

A legal separation agreement is a document that is used to protect the rights of both parties in a divorce case. In the state of Michigan, a legal separation agreement defines the specific terms of separation that both parties must follow. Such terms may include the division of assets and debts, child support, spousal support, and parenting time arrangements. Additionally, a legal separation agreement is considered an enforceable contract between the two parties. As such, the agreement should be considered carefully and be reviewed by an experienced attorney as each party’s rights and obligations will be specified in the document. Both parties must sign the agreement in order for it to be legally binding. A legal separation agreement should not be confused with a “divorce settlement agreement.” The former governs the specific rights and obligations of the two parties during the period of separation while a divorce settlement agreement is the document that is signed at the end of the divorce process that resolves all financial and other issues that needed to be addressed in the divorce.
