What is a post-divorce modification of child support?
A post-divorce modification of child support in Arizona is a change to the existing child support order in place after a divorce has occurred. This type of modification is requested when there is a significant change in financial circumstances for either the parent paying child support (the “payor”) or for the parent receiving child support (the “payee”). Common reasons a post-divorce modification may be requested include a change in job, a decrease in salary or wages, an increase in expenses, or a change in the number of children a parent has custody of. A payor may request a decrease in their child support payments while a payee may request an increase. In either case, the parent requesting the modification must demonstrate the financial change and provide proof of it. The court will factor in the payor’s and payee’s income, the amount of time each parent spends with the child, the expenses associated with raising the child, and other childcare expenses before making a decision on the modification. The court will also consider any existing child support or alimony orders that are in place. Each request for a post-divorce modification is looked at individually and each circumstance is taken into consideration. The court will make a determination if the requesting party has demonstrated a significant change in their financial circumstances and if the requested modifications to the current child support order is fair and reasonable.
