What is a post-divorce modification of child support?

Post-divorce modifications of child support refer to the adjustments made to an original child support order after a divorce has been finalized. In Kansas, child support orders can be modified if there is a substantial and continuing change in circumstances for either the custodial parent or the non-custodial parent. Typical circumstances that could warrant a change in child support order include increased income for either party, changes in child custody arrangement, or a decrease or increase in the physical needs of the children. In some cases, a post-divorce modification of child support is requested by one of the parties. In other cases it may be required by Kansas statutes. The intent is to ensure that the children involved in the divorce will be provided with the proper child support based on the current circumstances. In Kansas, child support orders can be modified by filing a Motion for Modification with the same court that issued the original divorce decree. This motion must be served upon the other party in the divorce action and that party will have the right to respond. The court will likely hold a hearing to consider the evidence provided by both parties and make a decision. After the decision of the court is issued, a new court order will be put in place with the new child support arrangement.
