What is considered a dog bite?

In Washington, a dog bite is defined as any physical contact between a dog’s mouth and a person’s body resulting in injury or damage to the skin, flesh, or muscle. These injuries can range from minor scratches and abrasions, to more serious and permanent damage such as puncture wounds, lacerations, and disfigurement. Even if a person does not suffer physical harm, but is reasonably afraid of being bitten, a dog bite has occurred. Washington law places responsibility for a dog bite upon the owner of the animal. The owner of a dog is liable for any damages caused by the dog, regardless of knowledge of the dog’s viciousness. In addition, if the dog was not restrained and the bite occurred off of the owner’s property, the owner can be held liable for all damages and medical bills resulting from the bite. This law applies to both owners and renters of a property. In Washington, there have been several cases in which victims of dog bites have successfully obtained compensation for their injuries. The cases have primarily relied upon the owner’s negligence in failing to control their animal, or failure to take reasonable steps to prevent the bite from occurring. It is important to note that in order to recover any damages, a person must have suffered an actual physical injury. Merely feeling afraid of a dog bite is not enough to receive compensation.
